1. INTRODUCTION

This site is owned and maintained by Bloodstock Media Solutions ("BMS"). anzbloodstocknews.com is a registered domain name and cannot be used in any other form, other than by BMS. Nothing in this website or otherwise should be deemed or construed as creating a joint venture, partnership or agency relationship between BMS and any other organisation.

Australia & New Zealand Bloodstock News (“ANZ”) is an independent organisation, wholly owned by BMS. Nothing in anzbloodstocknews.com or otherwise should be deemed or construed as creating a joint venture, partnership or agency relationship between ANZ and any other organisation unless otherwise stated.

2. ACCEPTANCE

This Terms of Use Agreement ("the Agreement") sets forth the legally binding terms for your use of anzbloodstocknews.com (“the Site”). By using the Site, and in consideration of ANZ providing the Site to you, you agree to be bound by this Agreement. You are only authorized to use the Site (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. We reserve the right to update or modify the Agreement without notice.

While ANZ takes all care in the preparation of this information it accepts no responsibility nor warrants the accuracy of the information displayed within the Site.

ANZ accepts no responsibility for any assumptions based or derived from any information displayed or assumed.

4.3

ANZ makes no guarantee of availability of the Site services and will not be held responsible for data loss or interruption of service of any kind.

To the fullest extent permitted by law, ANZ’s liability for breach of any implied warranty or condition which cannot be excluded by law is limited at the option of ANZ to the following:

in the case of services supplied or offered by ANZ.

  • the payment of the cost of having services supplied again,

6. REGISTERED USERS

6.1 ANZ Bloodstock Daily News

Australia & New Zealand Bloodstock News offers users who choose to register (“the Registered User”) access to our daily newsletter (“the Newsletter”), which includes news, results and statistics from Australia, New Zealand, Hong Kong and Malaysia.

The Newsletter may not under any circumstances be distributed in any way, including, but not limited to:- not modifying, copying, reproducing, republishing, uploading to a third party, posting, transmitting or distributing any material in any form without prior written permission from the copyright holder BMS.

6.3 User Registration Obligations

Subscription to the Newsletter will require you to register by supplying some personal information which may include but is not limited to your name, address, telephone number and e-mail address. In consideration for our enabling of your subscription to the Newsletter, you agree to: (a) provide true, accurate, current and complete information about yourself when necessary or as prompted by the Newsletter registration form and (b) maintain and promptly inform ANZ of any changes to this information to keep it true, accurate, current and complete.

If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reason to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your subscription and refuse any and all current or future use of the Newsletter (or any part thereof).

6.4 Canceling The Subscription

Registered Users may cancel their subscription to the newsletter at any time, with or without cause. Go to ‘REGISTRATION’ in order to obtain information on canceling your subscription.

Registered Users can also stop the delivery of future Newsletters by following the specific instructions provided in each daily e-mail.

6.5 Privacy Policy

We use the information we collect to provide the subscription you request. We do not share or disclose Registered Users’ e-mail addresses or personal information with other organisations. Our subscription may include the display of personalized content and advertising.

You agree that ANZ shall not be responsible for the timeliness of delivery of the Newsletter or be liable to you or to any third party for any delay, modification, suspension or discontinuance of the Newsletter.

6.8 Termination

You agree that ANZ reserves the right in its sole discretion, and at any time to discontinue providing the Newsletter, or any part thereof, with or without notice. Further, you agree that ANZ shall not be liable to you or any third party for any termination of your subscription to the Newsletter.

6.9 Access

Registered Users receive the Newsletter as a PDF document supplied by e-mail. In order to use the Newsletter, you must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device.

7. PAYMENT FOR ADVERTISING

Payment for advertising can be made from your credit or UK debit card. You may also send a cheque. All payments should be made in either Australian dollars or pounds sterling currency.

8. INTERPRETING THE AGREEMENT

The section titles in this Agreement are for convenience only and have no legal or contractual effect. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.

9. CHOICE OF LAW & JURISDICTION

This Agreement shall be governed by and interpreted in accordance with English law and you irrevocably agree that the courts of England and Wales shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with the Agreement. Nothing in this clause limits the right of BMS to bring proceedings against you arising out of or in connection with the Agreement (a) in any other court of competent jurisdiction or (b) concurrently in more than one court of competent jurisdiction
