Supreme Court halts Racing NSW’s bid to install ATC administrator

The Australian Turf Club (ATC) has won an important interim ruling in its high-stakes standoff with Racing NSW, after the Supreme Court found no compelling evidence that the club was on the brink of insolvency or unable to continue trading in the short term.

The decision ensures the ATC board, chaired by Tim Hale SC, will remain in control until a full hearing in February, preventing the regulator from enforcing its plan to appoint Ernst and Young as temporary administrator.

The urgent legal action was triggered earlier in the week when Racing NSW chief executive Peter V’landys announced the regulator intended to remove the ATC directors and impose external management. That move followed a show-cause notice issued in September, in which Racing NSW outlined what it described as “serious financial and governance concerns” and criticised the ATC’s response as lacking a credible strategy to stabilise performance.

In court, Racing NSW argued that the club’s weakening commercial position and uncertainty around its future capital structure created a material risk to racing operations and to the income of participants. Counsel for the regulator submitted that deteriorating financial indicators reflected poorly on the board’s competence and warranted immediate intervention to avoid what it claimed was a foreseeable slide into insolvency.

However, Justice Francois Kunc disagreed that the risk was sufficiently imminent or acute to justify administration before the substantive case was heard. He noted that, based on the material before the court, the ATC held approximately $29 million in cash and did not face any requirement to refinance its $30 million loan facility in the near term. Kunc also pointed out that Racing NSW itself had previously guaranteed the loan, making it unlikely the regulator would act in a way that jeopardised the club’s continuity.

“There is no persuasive evidence that the ATC will be unable to conduct its scheduled race meetings between now and February if the current directors remain in place,” he said, adding that the efforts being made by the board to address its financial position “should not be interrupted” by external control at this stage.

Kunc extended an injunction granted earlier in the week preventing Racing NSW from acting on its intention to replace the board. The court also rejected Racing NSW’s attempt to make directors personally liable for any losses arising as a result of the injunction, and declined to compel the ATC to provide further financial documentation before the hearing proper.

Hale, who has chaired the ATC through an extended period of negotiations with Racing NSW, welcomed the ruling and reaffirmed the club’s commitment to working with industry stakeholders.

“The Board of the Australian Turf Club welcomes today’s decision and will now continue to work diligently and collaboratively with all stakeholders to continue normal racing and club operations,” he said.

V’landys acknowledged the decision but emphasised its interim nature, reiterating the regulator’s belief that its concerns would be substantiated at the full hearing.

“It is important to note that this decision is only for convenience and in no way has it determined the case,” he said. “We are confident in our position and will continue to act in the best interests of the 50,000 participants to ensure their incomes are maximised.”

The dispute arrives at a time of intensifying scrutiny around racing administration in Australia. Dissatisfaction with Racing Australia’s governance – especially over stalled progress on black type policy – prompted the formation of the Australian Racing Industry Alliance (ARIA), a grouping of major breeders, auction houses, owner bodies and leading administrators. That coalition has sought to advance an independent model for determining the Australian stakes pattern, arguing that the current system has been paralysed for several years.

This week the Asian Racing Federation (ARF) intervened, announcing that its Asian Pattern Committee would temporarily assume control of the Australian pattern until a compliant, independent panel is established.

Although the ATC–Racing NSW matter is legally distinct, industry figures have noted that both disputes reflect the pressures facing racing administration as jurisdictions compete for commercial advantages while operating within shared national and international frameworks.

In the months ahead, the ATC will continue to operate its four metropolitan racecourses – Royal Randwick, Rosehill Gardens, Canterbury Park and Warwick Farm – with around two race meetings per week scheduled between now and the February hearing. Justice Kunc said there was “no persuasive evidence” those meetings would be better safeguarded under administration.

The full case will be heard across two days in early February, with both parties preparing extensive submissions on financial assessments, governance obligations and the statutory thresholds for regulatory intervention.

Until then, the injunction preserves the existing board structure and allows negotiations between the club and Racing NSW to proceed, though the pathway to a resolution remains unclear.

The outcome will carry significant implications not only for the ATC and its 2,000-plus employees, but also for the wider racing industry, which relies heavily on the stability of Sydney’s metropolitan program.

Magic Millions calling for Supercilious

The Leon and Troy Corstens and Will Larkin stable are planning a trip to Queensland for Magic Millions Day with Supercilious (Written Tycoon) who makes her return at Caulfield Heath in Saturday’s Magic Millions Vic 3YO & 4YO Classic (1200m) – her first run since an operation to overcome a breathing issue. Larkin said the Magic Millions Fillies & Mares (1300m) at the Gold Coast on January 17 was the aim for Supercilious, but first the mare needs to get some prize-money in the bank and increase her rating. "Being a Magic Millions horse, we would love to get her up north," Larkin said. "If she can run well in this, her main plan has been the 1300-metre Fillies and Mares race up there, but she needs to get her rating up before then. It will be a watch and see on Saturday but then she can have another run down here before she heads up." Larkin said Supercilious had always had a bad breathing grading, but the stable was hoping to win a race or two with the filly while still a three-year-old. "Throughout her last preparation, it was the worst grading that it could be, but being a three-year-old filly, we wanted to make use of running in those three-year-old races and hopefully pick-up some money and maybe some black type," Larkin said. "We kept her going until she turned four and then elected to do the surgery. It doesn't always work, but touch wood, it's been good."

King’s Secret set to reign over Randwick rivals

The laws of probability will be in favour of Joe Pride when he saddles up more than a third of the field in a Benchmark 94 (1100m) at Randwick on Saturday. The in-form trainer has Cool Jakey (Pierro) and Storm The Ramparts (Headwater) resuming in the ten-runner contest, while recent recruit Appin Girl (Capitalist) and King's Secret (Shalaa) tackle it second-up. When asked which he rated his best chance, Pride didn't hesitate. "King's Secret. He is perfectly set up for this race," he said. "He is a really nice horse and probably just needed that run first-up. Cool Jakey might go to the Gold Coast for the Magic Millions yet and he's better on a wet track. Storm The Ramparts might go to the Gold Coast as well, but he will run well. The one I think is under the radar is Appin's Girl. Her run was good the other day when she had to give them a lot of weight."

Archibald ready to put Mortal Halo’s potential to the test

Annabel Archibald is quietly confident Mortal Halo (Better Than Ready) can give a good account of himself when he lines up in a Benchmark 72 over 1600 metres at Randwick on Saturday. The brother to stablemate Port Lockroy will have just his second attempt at the mile, his previous attempt coming when tenth of 16 in the JJ Atkins (Gr 1, 1600m) back in June. “As a two-year-old he was very green and didn’t really know where to put his legs but he’s come back better this time in,’’ Archibald, who trains in partnership with her husband Rob, told Racing NSW. “We see no reason why he won’t run the mile, his full-brother is a Group 1 winner over the mile so I can’t see it being an issue. He’s got a nice inside draw, he still gets in on a pretty light weight so he will be up there. The stable will also be represented in the race by Fiftyfivechevy (Puissance De Lune) who finished fourth over the same course and distance last weekend. “He’s racing well and probably needs everything to go his way to win at this level,’’ Archibald said of the three-time winner. “He was a little one paced the other day so we thought we’d put the blinkers on, he’s a horse that rolls forward and makes his own luck. We’ll run him again over the mile then there’s a 2000 metre [race] in a couple of weeks.”

Options aplenty for talented Ripley

Connections will keep an eye on underfoot conditions at Randwick on Saturday before deciding if talented colt Ripley (Too Darn Hot) will take his chance in a Benchmark 72 over 1300 metres. Listed-placed on his most recent outing, Ripley is being aimed at next month’s Magic Millions meeting and Johann Gerard-Dubord, assistant to Ciaron Maher said there are plenty of paths he can use to get there. “We’ll keep an eye on the track, we wouldn’t want it to be too firm and there’s a Gosford Guineas next week,’’ he told Racing NSW. “He’s a well bred colt, won his maiden well and went into stakes company after that and ran well. He’s drawn well [barrier three] , the horse is well. He does have a big weight but has a good gate and would put himself there not too far away. The 1300 metres on a big track will suit him so there are positives.”



Another win on the table for Lancelot Du Lac

There will be few better related horses in action at Randwick on Saturday than Lancelot Du Lac (Flying Artie) and his trainers are optimistic he can add to the family legacy. The colt is a half-brother to last year’s Golden Slipper (Gr 1, 1200m) winner Lady Of Camelot (Written Tycoon) and Group winners Platinum Jubilee (Zoustar) and Queen Of The Ball (I Am Invincible), with all but the latter prepared by Gai Waterhouse and Adrian Bott. Bott said Lancelot Du Lac is in a different mould to his older sisters but is showing his share of talent, as evidenced by his stylish debut win on the Kensington track earlier this month. "Physically he is different to those. Different breeding, different sire lines there. And he profiles a bit differently to what they have," the trainer said. "It was an excellent win on debut. We have given him plenty of time and been very patient with him." Lancelot Du Lac will try and make it two wins from as many starts when he lines up in a Benchmark 72 (1300m) and Bott said: "There's a lot more upside to come once we can see him over a bit further and in time. The only query about Saturday is going up in grade and remaining at that trip. Other than that, he couldn't have been any more impressive on debut. He put them away quite well."

Hayes upbeat about Apulia's chances

Ben Hayes is confident Apulia (Fiorente) can bounce back strongly from his unplaced run in the Northerly Stakes (Gr 1, 1800m) when the talented five-year-old runs again in Perth in Saturday's Ted Van Heemst Stakes (Gr 2, 2100m) at Ascot. "The other day he just got too far back from the barrier and his work through the line was very good, he was just never in the race," Hayes, who trains in partnership with his brothers Will and JD, told Racing.com. "But in hindsight it might have been a good thing because he had a nice, easy run. He's come through it excellent. It's a beautiful run to head towards this race over 2100 metres, which should be right up his alley. From the inside draw he should naturally settle closer and we've got the leading rider in the state there on board in Willie Pike. We're quite confident he's going to run very well with the way he's come through his last run."

John Dory out to make a splash in Grand Prix

The Chris Waller-trained John Dory (Ace High) will contest the Grand Prix Stakes (Gr 3, 1800m) at Eagle Farm on Saturday, with his trainer already eyeing bigger targets. “He is a really nice progressive horse,” Waller said. “I pick out one horse each year to target this race with the view of the horse having a break and then going back up to Queensland for the Derby.” Waller produced Kovalica (Ocean Park) to win the Grand Prix in 2022 before going on to win the 2023 Queensland Derby (Gr 1, 2400m) while he also used the race as a stepping stone for Queensland Derby placegetter Caboche (Vadamos) in 2021. “It has worked with good success in the past,” the trainer said. “John Dory is a nice middle-distance bred horse. He is a typical New Zealand product that keeps improving and now is the time that you back the New Zealand bred horses to equal up with the Australians and often go ahead. At his last start, he had a big weight to carry as topweight and had a gap between runs. He will be better for that experience from a fitness perspective and race experience. Winkers go on on Saturday, just to sharpen him up a little bit. They went very slow last start, so hopefully he will get a more genuine speed, which would be a big help. We expect him to be fighting out the finish and not just that, come back a better horse in the late autumn.”

Heathcote keen on Fabulantes

Robert Heathcote believes his runner Fabulantes (Star Turn) has a good chance of turning the tables on Kelly Schweida’s in-form sprinter Grafterburners (Graff) when the pair clash again in the Gold Edition Plate (Listed, 1200m) at Eagle Farm on Saturday. Fabulantes is coming off a close-up fifth behind Grafterburners in the Pierata Plate (1200m) at Doomben on December 6 and Heathcote told Racing Queensland: “I thought his run behind Grafterburners was terrific and he was only beaten by a small margin on a firm track, which didn’t suit him. I think he’s a chance on that run, but Grafterburners is a tough nut to crack and he’s a quality horse. Fabulantes is a better chance than his $20 price at the moment. But, Grafterburners is still the proven star now that Cool Archie is out of the race.”

Changes to All-Star Mile conditions announced

Minor changes have been made to the race conditions for the All-Star Mile (Gr 1, 1600m) ahead of its second running as an elite-level race next autumn. As announced in July, the All-Star Mile prize pot is now $2 million, which means that the breakdown of prize-money has been changed with the pool to be split across the first eight horses only, as occurs in other Group and Listed races. Previously, all starters were paid a share of prize-money with a capacity for 16 runners at Flemington. The number of “win and you’re in” races has also been reduced to four. The Elms Stakes (Listed, 1400m) at Flemington, Futurity Stakes (Gr 1, 1400m) at Caulfield, Blamey Stakes (Gr 2, 1600m) at Flemington and the Australian Guineas (Gr 1, 1600m) at Flemington are the four races where the winner will automatically gain entry for the All-Star Mile, which will take place at Flemington on March 7. The Orr Stakes (Gr 1, 1400m) is no longer an automatic entry race.

Gosford ready for return of major races

Officials at Gosford are looking forward to the Belle of the Turf Stakes (Gr 3, 1600m) and the Gosford Guineas (Listed, 1200m) returning home on December 28, having been run at Wyong last year due to major course renovations. “It is fantastic to have our Belle of the Turf and Gosford Guineas meeting back home - and we are incredibly grateful for the continued support of Gosford RSL, whose long-standing commitment to our community and to racing remains invaluable," said Gosford Race Club's CEO, Daniel Lacey.

RQ appoints key Racing Review role

Racing Queensland has appointed experienced racing administrator Mary Collier to lead the implementation of the Queensland Racing Review’s recommendations. Collier commences at RQ on Monday and will establish an implementation team to progress the review’s recommendations endorsed by the Queensland government, with a roll out plan to be developed in the New Year. This includes significant legislative reform, operational changes and infrastructure works to deliver on the recommendations. “Mary Collier’s extensive background in racing administration and positive relationships across the industry made her the ideal choice to lead this process,” said racing minister Tim Mander.

Cole pair up for Trentham Challenge

Latrelle (Redwood) and Old Bill Bone (Swiss Ace) may not be ideally suited by the conditions of Saturday’s Manawatu Challenge Stakes (Gr 2, 1400m) at Trentham, but there’s belief they can rise to the occasion, according to the pair’s trainer Cody Cole. Latrelle and Old Bill Bone will be tested at weight-for-age company, earning the step up after performing well at handicap level. “They’re not that well suited, but I had a feeling the race may lack a bit of depth and it’s come up that way,” Cole said. “It was a really good run at Wanganui last start by Latrelle and she was taking ground off two better performed horses [Spencer, Bedtime Story].” The mare came from the back to finish third and will be ridden by Samantha Collett while Vinnie Colgan will guide the fortunes of her stablemate. “Old Bill Bone is the improver, he’s still on the way up and always seems to find a way to get in the finish,” Cole said. “You never get a good line on him from trackwork, he’s so laid back whereas Latrelle has been working particularly well so they are hard to split.”

Atmospheric ready for Manawatu Cup

Atmospheric (El Roca) will fly the stable flag for Cody Cole in Saturday’s Manawatu Cup (Gr 3, 2300m) with Craig Grylls to retain the ride after they overcame a slow start in Rating 75 (2100m) company at Pukekohe last time to finish runner-up. “He’s in on the minimum and a bit shorter in the market than I thought, but the numbers were good from him at Counties last start,” Cole said. “He can’t afford to give them a head start like that on Saturday, he’s been to the jump-outs since then and got away cleanly. He’s got a nice, cosy gate [barrier five] and as long as he gets away with them, I think he’s got to be a very nice chance. He’s had the benefit of a run over ground, so he’s spot on.” Stablemate Silhouette (Armory) will return to Trentham for the Wakefield Challenge Stakes (Gr 2, 1100m) following her runaway victory at the same track in October. “That was the drawcard to have a crack, it’s a nice option for her having been down the chute before,” Cole said. “The margin was bigger than expected but we thought she would run a top race. She had worked well with an older horse leading into it. The Karaka Millions is a goal along the way, but first and foremost I’d like to get some black type on her page.”

Crocetti back on track for Telegraph

Group 1-winning sprinter Crocetti (Zacinto) is back on track for a tilt at the Telegraph (Gr 1, 1200m) at Trentham in a fortnight following a setback earlier this month. The five-year-old gelding, who last raced in The Quokka (1200m) in Perth in April, was making pleasing progress in his build-up over spring, winning his 1100-metre trial at Te Rapa in September before he was set to head to Pukekohe to tackle the Concorde Stakes (Gr 3, 1200m) a fortnight ago. However, his temperature spiked earlier in the week, forcing Danny Walker and Arron Tata to withdraw their charge from his intended first-up assignment. Crocetti quickly recovered and his trainers shifted their sights to the Group and Listed trials at Matamata on Friday to help ready him for Trentham’s feature sprint. In his 1100-metre heat, he jumped away well under Warren Kennedy before bounding away to an effortless one-length victory. “It is really good to have him back on track,” owner-breeder Daniel Nakhle
said. “It has been nine months between races, so we are looking forward to Telegraph Day. He had a nice trial today, he had a little bit of a blow, which he needed. It was good to have that pipe opener and hopefully have him spot on for the third [of January].”

HK: Newnham aiming to make Derby mark

Mark Newnham is hopeful a strong performance from Invincible Ibis (Hellbent) at Sha Tin on Saturday will be enough to keep Zac Purton aboard as the gelding heads towards the Hong Kong Derby (Listed, 2000m) in March. Invincible Ibis has made an excellent start to his four-year-old season, producing two wins and three placings from five starts, with Purton partnering him to consecutive victories at his past two outings. But with Purton traditionally commanding his pick of the crop, Newnham is under no illusions about the task of retaining the champion jockey. “Zac rides who he wants and it doesn’t always suit me,” the trainer said. “I chased Zac for this horse, but he’ll jump off just as quickly. As we head to the Four-Year-Old Series, he probably has his pick of six or seven horses. After this race we’ll find out if Invincible Ibis is in his top two or three, or whether he casts him aside for something else.” Invincible Ibis steps to 1600 metres for the first time in the final event on Saturday’s programme as he continues his progression towards Hong Kong’s premier domestic feature on March 22. Newnham heads into the weekend level with Caspar Fownes atop the trainers’ table on 24 wins following Wednesday’s Happy Valley meeting, while Purton leads the jockeys’ premiership on 48, with Hugh Bowman next best on 22.

HK: Bowman seeks to maintain December momentum at Sha Tin

Hugh Bowman will bid to maintain his rich vein of form when he heads to Sha Tin on Saturday with seven rides, as he closes out 2025 on an upward trajectory. Bowman has been one of the major movers this month, riding six winners, eight seconds and a third so far in December, a run that included a midweek double at Happy Valley on Wednesday. He sits second in the Hong Kong jockeys’ premiership. “I’ve had a good couple of weeks, and let’s hope we can keep it going through into the new year,” Bowman said. His best chance of adding to his tally on Saturday appears to be the Danny Shum-trained Gorgeous Win (Press Statement), who lines up in a deep edition of the Class 2 Ivy Handicap (1200m). The five-year-old returned to form two weeks ago when scoring on the Sha Tin dirt over 1200 metres, taking his record to six wins from 28 starts. “He won with authority. There’s no questioning the horse’s class,” Bowman said. “He’d been moving really well leading into that run, and I was confident he’d enjoy the all-weather. He wasn’t performing on the firm turf, but with more forgiveness in the ground, we saw what he can do.”
